I’ve certainly had a taste of controversy in the Confederate flag forum, so I thought I’d post a little something in a less controversial thread (like abortion ). Anyway, the following post is intended both as an informative post and also as an argument that Roe v. Wade should be overruled (even though I am pro-choice). The post is long, but not comprehensive by any stretch of the imagination.If you don’t like long posts, and if you’re not interested in actual abortion laws in the US, then the following post will not appeal to you. Otherwise, if you have strong views on abortion, you should try your best to learn about the actual legal issues (in addition to the moral and scientific issues); you’ll make a much better pro-life or pro-choice advocate if you know the state of the law.Finally, if you already know all of this, I’m not trying to patronize; I’m just donating what information I have to the A2A forums Background:As all of you probably know, Roe v. Wade prohibited some forms of abortion regulation by the states. Let me be clear about the holding of Roe, as I’m not sure that everyone knows the whole truth. Roe essentially held that (1) states are not allowed to restrict abortion in the first trimester; (2) States may only regulate abortion in the second trimester to protect the mothers’ health; and (3) States may regulate the third trimester but must allow abortions for medical reasons. Roe was derived from the “right to privacy,” which was derived from the “Due Process” clause of the 14th amendment. Roe is also not the most recent Supreme Court abortion case. Current Constitutional abortion law is embodied by the entire Roe line, ending with Planned Parenthood v. Casey, which abandoned the trimester approach and held that “…a State may not prohibit any woman from making the ultimate decision to terminate her pregnancy before viability.” Without getting into the details of that line of cases, I’ll just say that the current state of the law is that we cannot vote on abortion; it’s a right mandated by the Constitution through the Supreme Court’s interpretation of the 14th amendment. The Factual Foundations of Roe and its Progeny:The Supreme Court recognized in Planned Parenthood v. Casey that the issue of when “life begins” is crucial to the abortion debate, but the Court also acknowledged that there is neither a religious nor a scientific consensus about this question. However, the Court has held that a fetus does not fall within the Constitutional definition of “person.”To further elaborate on the scientific aspect of this issue, it’s doubtful that science alone could ever provide an answer to the “beginning of life question.” In my opinion, every allegedly scientific definition of “living human being” and “the beginning of life” created for the abortion debate has been either underinclusive or overinclusive, and they tend to prove nothing more than one’s semantic abilities. Regarding the religious aspect of this debate, many Protestant denominations and Judaism (for the most part) hold that life begins at birth. Other Protestant faiths and the Catholic faith hold that life begins at conception. It’s an open question…The Legal Foundations of Roe and its Progeny:As I previously said, Roe is based on the “Right to Privacy” found in the 14th amendment. If you have a Constitution handy, and if you peruse the 14th amendment, you’ll probably note that the word “privacy” does not appear. In fact, many of our “Constitutional Rights” are implied rather than explicit. The rights implied from the “Due Process” clause of the 14th amendment, including privacy, have created some very complicated and heated legal debates (I’m certainly not an expert on this, so I won’t try to write a treatise on the subject). Anyway, if you have neither the time nor the desire for a Constitutional Law class, you can just take the following assertion on faith (Steppen wouldn’t lie, right?). My assertion is that it wouldn’t undermine the Constitutional “right to privacy” if abortion was not included in this right. Specifically, an abortion necessarily includes a doctor, and so it’s not the same sort of privacy found in some of the earlier cases (regarding contraceptives, for instance). Furthermore, it wouldn’t be all that horrible if the “right to privacy” simply weren’t implied from the Constitution at all gasp. After all, the word “privacy” is nowhere to be found in the Constitution, and if people want a “right to privacy” then we can pass an Amendment. Why I would Drop Roe: I would exclude abortion from privacy (or remove privacy, period) because the core factual questions are extremely contentious, and because the Constitutional Right is very flimsy and contrived. Considering this flimsiness and contentiousness, it seems appropriate to allow democratic deliberation on the issue. Let the people debate it and vote on it! Overruling Roe doesn’t mean that we make abortion illegal; it only means that each state can vote on the issue and make their own laws according to the will of the people.

I agree with the last paragraph whole-heartedly. Sectional lines make great divides for political and religious views (hints the "Bible Belt"). I think stuff like this as well as gay rights should be left up to the people of each state to decided.

Anyways...The glory of the United States constitution is that it can change according to the times. That is why a lot lot lot is implied by the constitution, but is not literally written. (not literally written in the constitution, there's a word for that! Grrr, what is it, final is coming up!)Okay, so in the time of Roe vs. Wade technology in the area of contraceptives was not as far as it is today. In this case, things need to be changed!This also goes for the cyberspace laws. The first laws were passed several years ago before the internet was as developed as it is today.Today is an everchanging world that needs to change to keep up.
