Earlier today we had a lovely discussion about second amendment rights in the US. It was off topic but a cali discussion. So I thought Id bring up a first amendment right and see what happens with this discussion.

Well it sure as hell eroded them, but they are still there so long as you dont speak out against he big dubya and cant ever be mistaken as speaking out against government and its ever more reaching control.I personaly hate the bastards, Bush, Dick, Rummy and that snake bastard who slid out but drafted all of hte patriot act to begin with Ashhole err ashcroft.This particular case though I think says alot about current state of America. it draws very real similaritys between that school paper and the media every where. If you agree with the managment its ok to print but conflict with thier views and your lucky if it gets printed.I also wanted to include that particular article for A2A because they got in so much shit for the same things that we discuss here daily. Thought it should interest most people who frequent this site anyways.

The case law, as it developed in the past 10 or 20 years, indicates that students on school newspapers don't really have any First Amendment rights. The school owns the "presses". In fact, you don't even have the right to print you own leaflets and distribute them on school grounds, which seems a bit hazier to me, since a school is ostensibly a public place, and no public materials are used.The bottom line is that people under 18 don't have the full gamut of Constitutional rights that adults have. But with the popularity of the Internet, what happens in school (w.r.t. distributing information) is becoming less important.The "Patriot Act" does impinge civil rights in a big way, and makes the U.S. much more like a fascist police state, with very little gain. Whoever voted for Bush gets the blame for this; the Patriot Act was a known entity before the election.Thank you, Bush voters. I hope you don't check out the "wrong" books at the library. No one will tell you when your files are examined. Is this why all those people are getting killed and wounded in Iraq? Nothing makes sense.

You mean I learned the whole freaking constitution for nothing?!no I'm kidding. But my teacher has forced us to learn about our constitution and the 27 ammendments. the first 10 being the bill of rights. memorizing the preamble (for what I ask), and we've written the declaration of independence everyday of the week from the first week of school till now. I'm dying but hey. I doubt I'll become a politician... but it all depends.

You have to learn that because everyone before you had to learn it and recite in front of the class. I may ot know the entire preamble any longer but I still remeber most of it and I was forced to learn it around 8th or 9th grade. I graduated in 1989 from high school, thats stuck in your head pretty much for ever or until you go senile.I had to learn it its only fair that you and everyoe after you has to as well.

In some areas, school principals and administrators are taking disciplinary action against students who criticize school administrators using bad language, or who say nasty things about other students on their blogs.Edit: D'oh! I almost mist the whole point!

Its a good damned thing that wasnt enforced when I was in school. Id of been kicked out long before graduation.
