It's against the law to have sex with someone so heavily under the influence because they can't consent. This backs up what I was taught.
It's only a violation when the person is "out of it."

In this situation I think it best to discuss what has happened with the girl. By letting them spread rumors and having the girl talk about beating you up is only going to exacerbate the problem. If you talk to her and possibly apologise for what has happened then the issue could go away without incident. Try to tell her why you dont think you used her and why you feel you had conscent.

well dude, to be honest if she says you 'used' her, it probably means she expected you to ask her out soon after, and im guessing you didnt. i suggest talkin it out with the girl you fucked, asking her to cool down, explain that you liked her and your sorry, you just got a little scared...hell maybe that isnt the truth but its the best thing to say if you dont want any more trouble. and as for this ex gf, tell her to mind her own business- if she insists on fighting you, well, dont hit girls. just walk away from it, and if shes absolutely batshit and is throwing serious punches at you, hold her forearms and push her away til shes at arms length- and tell her to calm down- looks better than hitting the bitch and feels better than getting smacked around.kinda screwy how if a girl hits you, its like 'haha you got beat up by a girl' when i hear people say that its like, so what asshole? I dont think he likes her, I've been reading more about this guy and I'm actually going to side with the girl, this guy seems like a jerk and cares nothing for her feelings. He took advantage of her even if she said before she was under the influence, its a law. So... I actually can't sympahtize for this guy, he got himself into it, and he's lucky she isnt pregnant.

I'm sceptical, CBW, when someone says "it's against the law" without saying at least in which jurisdiction. In the US this would be expected to be state law, and therefore different in each state. There are many things that are of course illegal everywhere, but I'm doubtful about this one.I've seen "it's against the law" statements in advice columns that I've known to be untrue.
