I am 18 and my girlfriend is 16...We've began to get sexually active and now it is quite possible that she could be pregnant. Can I get arrested for statutory rape or whatever? We live in Georgia if that helps on different laws. I've heard they vary from state to state?

I don't think that's true. Parents are just a third party. If there's any way that a DA can make a case against you (i.e., if he can gather enough evidence), you are risking jail time.

Well, if the age of consent is truely 16 than you should be fine. And the only reason the DA would even get involved if tis a repeated "offense" meaning he's 18 and he continues getting 16 yea old girls pregnant etc etc (only one example why a DA would get involved, there are more).Also as someone else said as long as her parents are cool with you, you're bases are covered.

I don't know about that Steve. I think as long as your parents (or the girl) do not press charges, the guy will not be arrested. I just turned 16 when I got pregnant and the father was 25. We didn't press charges and nothing happened to him.

If you're parked on a lover's lane and a police officer walks up to your car while you're in the (consensual) act, you can be busted. But if no one tells the police, how are they going to come after you? If you give birth in a hospital, they're not usually interested in turning in people in cases like that.

Yes, parents can press charges for anything that has to do with thier minor child. And I don't think giving birth in a hospital has anything to do with whether the guy will get in trouble or not. I got a letter that said we had to get a paternity test, and then we had to go to juvenile court to set up a child support agreement. I think that is all they (the state, welfare, whatever) ultimately care about anyway, unless the parents make an issue out of it. Also, my sister-in-law filed charges against a 21year old for having sex with her 15 year old. It was consentual, but he still went to jail. Nothing would have happened to him if my sister hadn't pressed charges.

Absolutely. Statutory rape isn't just a term used, its a law and can be punished by very long prison sentences.

I'm no expert in criminal law, but can't anyone file a crimial complaint? Then the police will investigate, and if they think there's probable cause, they'll make an arrest. Then the District Attorney will decide to bring charges if he thinks there's a case.I assume anyone can turn in a 21-year-old who statutorily rapes a 15-year-old. What if the parent(s) can't or won't file a complaint?
