I'm sure a Wal-Mart had plenty of security cams. I hope the local D.A. pursues criminal charges. I'm not sure what they would be maybe negligent homicide and certainly interfering with emergency responders.

I don't know what the first people in the crowd did since I haven't seen any video about it, but suppose they tried to hold back but the mob kept pushing from behind. How do you prevent trampling?

You don't. Separating the actions of the individual from the actions of the crowd, I think, would be near impossible. The reality of the situation is it's probably not worth filing any charges. The most you could get anybody for would probably be misdemeanor-manslaughter, even that might be a stretch.

That is the exact reason I have never beneout on Black Friday.... until this year. Though I did wait until like 1pm before heading out and it wasn't nearly as bad (though still some crazies out!!). But I have heard horror stories.. my own mother almost got into a fight with a lady because the lady tried to take something out of my mothers cart because that toy was sold out. When my mother told her to get lost the lady got into my mothers face... thankfully the store security seen what was going on before it got out of control and threw the other lady out.But plus side I got Adam's christmas shopping finished hehe

I've been pretty upset about this. I've always hated Black Friday early morning rush sales. My mom was at Wal-Mart at 5am Friday. We have a Super Center that just opened, so it was a particularly big deal. I keep thinking that could have been my mom!But I've come to understand that not everyone who marched on by the guy is guilty of callously passing by a dead man. When you're in a moving, rushing mob of people like that you have basically 2 choices: keep moving or get trampled yourself. But someone, somewhere in the front of the pack, is guilty of knocking down the guy. That guy (or girl) should have his or her chestnuts roasting over a prison fire every Christmas for the rest of their life.It's official. The newly discounted price of a Wii = one life.Something needs to be done about this crap.

That's what is so crazy about the whole deal. It's hard to know. I guess without the videotape we can't know. But there's a part of me that is so pissed off at this that I want someone to blame. And I also know that a ton of people in those retail crowds are assess. Fighting over toys, stealing electronics from other people's carts...heck, we even had a grown man assault a 3 year old boy here over a video game. So I don't have a hard time at all believing that a good many of these people are placing the value of plastic and computer chips over the lives of others. Evidenced by the fact that customers in that New York Wal-Mart threw a blue fit when the police tried to close the store.

the sad thing is that there may never be a way to assign blame to any individual(s). Obviously, the whole plan for that day at the dtore was flawed.As the employer of the victim, Wal-Mart will carry liability. They may be sued, in wich case their insurer will have to pay instaed of Wal-Mart. On the slim chance that the insurance claim cause a rate hike for Wal-Mart, that will just be added to the cost of doing busines and marked up in the sell price of the products. The sick irony is that the customers will, in fact, pay for the litigation with a nickel here and a dime there.
