I presume the company's smoking ban applies to everything. Just being in LA and breathing the air is probably bad for you, but there are "legitimate" reasons for being in LA. There is no legitimate reason to smoke (pleasure is not considered legitimate), according to the company's president. Or whatever reason there is to smoke is far outweighed by its cost.

I have to agree with SteveA about being skeptical when seeing "scientifically proven". Look at infomercials for those useless health products, where everything is "scientifically proven" to be effective (although, this is tricky, because effective can be interpreted different ways. A diet pill might help you burn 10 extra calories after each meal, which technically is "effective" .but yould you think it is?)Researchers often tend to exaggerate claims. They can receive more grants to further study the claims. While it may be true that secondhand smoke is more damaging to health, the majority of "secondhand" smoke that people are exposed to is the filtered smoke that is exhaled by the smoker, not the smoke trailing from the end of the cigarette.Back to the original question, I can see some valid points as far as worker health concerns go, but for the most part I don't think it's fair. Some people only smoke every so often (when drinking, et cetera), so I don't think it would be fair to fire someone like that when it's not really any more detrimental to their health than breathing the air in some large cities.As mentioned earlier, skiing,and activities as such could be considered high risk. Walking around some parts of cities is high risk. Should people be fired if their calorie intake is too high, because they might become obese and unhealthy?The only time I smoke indoors is maybe at a bar, or other "recreation" center where it's allowed. I smoke in my car, but only if I am by myself, or if the person riding with me smokes. I only smoke in other people's cars if they smoke as well. If I smoke outside in a pubic place, I don't smoke where there are a lot of people, so I am not blowing smoke all over them.
Well you can be fired for other things like your apperance, those are personal choices. Employers can discriminate against anyone they want as long as it hasnt been deemed not policaly correct to do so yet.
Smoking wherever is so simple for me ... if I'm in my friends car I ask if I can smoke (unless I know I can/can't) .... if I'm in any public place, I'll smoke, I don't give a shit if other people like it, get over it. Go somewhere else.
