Do you get a call home when u get booked by the cops for smoking weed. They got all the info and then just told us to go home.
-
Got booked...
-
My friend said the cops called his house randomly after he got busted for possession. So yes, I think they will.
-
Do you mean while you're still in custody, or post-custody?The only reason I could see them calling you post-custody would be to set up a date for the show-cause hearing, or the official court date.
-
other points i would like to make this is my very first in counter with the police. and this is Canada we are less strict about marijuana. ANynoe here from Canada know? I am friggin scared.
-
Well, I hope you are scared straight about drugs. Like Helms said, if you plan on continuing to possess drugs, then this is something you will have to deal with. The only thing I can tell you to do is talk to someone about the possibilities of what can happen to you.
-
Have you tried doing a Web search? I googled canada law marijuana possession and found this site, for whatever it's worth: It's the Law: Marijuana, which referred to this site from Canada's Department of Justice: Youth Justice Renewal.
-
Dude,
It really depends on the amount you were busted with and what state youâ€(tm)re in....In Texas, your ass would be sitting in the holding cell for juvenile detention center until your parents came and bailed your ass out....
Hope you learned a lesson.... If I were you I would be man or mature enough to let the folks know before they get the summons
-
This is why you do it in the house. You're safe if you have a gram. How did you get caught anyway? You have the Smell Doctrine!
-
well i never got caught with drugs, they knew we were doing it because our eyes were red. But we told them we did 2 grams. And they asked who was the one holding it and it was sum1 else.
-
they were in a parking lot with a honda civic... and we happened to come by and start yelling and donig stupid shit around that area and we went to the school and i think they thought we were vandalizing the school or sumthing. First they asked if we were drinking booze, but they saw one of my friends eyes were red as hell
-
It may be worth getting a lawyer involved at this stage, since unless you personally confessed, the case against you seems weak.
-
Yea - I agree with Ineligible. You didn't get booked for drugs. I'd say Disturbing the Peace and Vandalizing. Maybe Refused to give a breath sample?Your friend was drunk.
-
i told them truthfully everything that happened... and we didn't vandalize the school and they believed us. Just a bunch of kids running around after smoking alittle. I learned a good lesson. ITs jsut not worth it.

You haven't been charged with anything, and therefore haven't been arrested, which means you haven't been booked (that alway reminds me of Hawaii Five-0). Whoever admitted to the police that they were using drugs was very naive. They could have just said that they have allergies, or that they haven't been sleeping well. You'll have to wait to see what the police and district attoney (or whatever the Canadian equivalent is) decide to do.
-
It would be the Crown Prosecutor (equal to the DA) but the police will lay the charges. You said you're Canadian, and I figure you're under 18? Good, because I work in a detention centre that works with adults and young offenders You fall under the Youth Criminal Justice Act (12-17 years old), it tends to be one of the most liberal and rehabilitative laws out there. You were more likely brought into the police station to scare you straight; if they were going to charge you with something serious they would have held you and sent you to a detention centre. In all honesty, if you are charged, you will not be sent to prison for this, nor will you be on probation for years. Since this is your first offence and otherwise isn't all that bad (It wasn't violent) you could be looking at something called a "Conditional Discharge". What this means is that you may have to attend some sort of drug counselling program (such as Narcotics Anonymous) and when you've completed it, your charges will be erased from your record. IE: You never existed in the court system, life goes on.You may read too that your Young Offender record is sealed after you turn 18. This is not true, anyone with access to CPIC will be able to see what you've been charged with previously, unless you have been granted an absolute, or conditional discharge. My advice to you is this: If you are charged; be honest, admit your guilt, don't make excuses, and express your regreat. I would be very surprised to see you get anything more than a program order, and maybe some community service.PS. Do not reveal many details about this case, or any identifiable info, it violates many privacy laws if you're a Young Offender.
-
Also, don't take this for granted. If you continue this behaviour or be around people like this in the future, you will end up in prison.Even more worrisome is that you could graduate into an adult offender, with a life-long record.
-
That's all very well said - and quite acute . Don't forget - It be better to admit it. Take the plea bargain and if you do go to court, choose trial by judge, not with Judge and Jury. Juries usually have a biased again drugs. The Judge will follow the precedent of the Law. In reply to:You were more likely brought into the police station to scare you straight He should not have been taken to the police station - The Police Officer would've have given him an Appearance Notice. In reply to: My advice to you is this: If you are charged; be honest, admit your guilt, don't make excuses, and express your regreat. I would be very surprised to see you get anything more than a program order, and maybe some community service. Good point. If he admits to the guilt, then he'd get a lesser sentence. Unless the court stays the charges, in which I highly doubt. Hawker, there have been significant changes to the Controlled drugs & Substances Act so the O.P won't receive horrid punishement. Unless there is 'intent' 'mens rea' 'actus reus' In which there is. Also, he didn't use a weapon, had intent to harm, and his motive was only to "joke" around. In other words - This won't even make it to trial.
-
It's very good, and is much appreciated, to have someone of your experience, Hawker23, to advise in this situation.
-
He never made it clear that he was brought to the police station. He wouldn't have been "booked" unless he was formally arrested; he didn't say that he was arrested. Were he arrested, he would have been charged with some specific crime.I hope he didn't dispappoint Queen Elizabeth too much.
-
If you get arrested and charged with a crime, get a lawyer and listen to him.If you don't get arrested, you're off the hook. Consider it a life lesson.
