I got a question of a medical nature.94 old year man with alot of issues. (8 cm anuerism, cancer and other issues). Breaks his hip.Family member finds a 4 inch gash on his arm which is fairly deep.Doctors insist he be operated on when it has already been diagnosed that anastesia would kill him.Any chance in hell of winning a lawsuit for negligence?

A doctor insisting that someone has surgery is not illegal.
He can't do the surgery without a consent form signed by the patient or his family.
If they sign the consent form knowing the risks, they would probably have a hard time suing over the outcome, unless they could prove some sort of coercion. -
I'm neither either, but I agree with damien.This is a situation where he is likely to die soon in any case, and it's a question of relative chances. So long as no relevant information that should be known is withheld from whomever is making the decision, there's no basis for a lawsuit. (Unless the operation itself is botched.)

We told them flat out the anastesia would kill him. They still suggested surgery about 6 times =/.we already looked into surgery a long time ago for his other problems anurism, blood clotts in his neck, swelling of legs. All times we were told the anastesia would be the equivelent of euthinasia. At this point we told them about all the past incidences and why he can't have surgery.They still keep asking if he should have it =/. Trying to get concent from my mother.

Has your mother had a discussion with the doctors about this?Maybe she should talk to them and find out why they think it would be a good idea for him to have the surgery, knowing the risks with anesthesia. Maybe they have information she doesn't. Ultimately, they are not gonna do the surgery without her consent. It sounds like there just needs to be more communication.

A doctor talked to her today and tried to guilt trip her."if he doesn't have the operation he will be bed ridden the rest of his life..""if he doesn't have the operation he won't be able to walk again" (he could barely walk before this).Things like that =/.

What I'm interested in is why the doctor seems to think the risk of not walking again trumps the risk of death.That's the question you and your family should ask him. Make him answer it. Your family has the right to be informed and to be treated with respect, not guilt tripped and patronized. You should demand nothing less. If you're not happy with what this doctor is doing, and he refuses to have the discussion he needs to have, you should go to the chief of staff.Too often people just take what doctors say and don't question it cause they're doctors and they're smarter than we are...supposedly. Usually, this works cause most doctor's are good people. But occasionally it pays to ask questions.

My family usually is one to ask questions. However, I think in this case we have 3 years of medical records saying he can't be operated on for anything.We have made the doctor clear of it.My mom managed to take a picture of the gash.. found out they cut him with scissors when trying to remove some tape or some shit like that.Anyway we have told them countless times he can't be operated on. We would ask questions but, the simple fact is we know the mans time is near. His quality of life has been shot to hell over the last few years. (downhill fast since he had the stroke) hell most people thought he would die in a month (first the blockage) then the anurism, then cancer then this then that. here we are 3 years later and the man is defying all odds by living this long.I hate to say this I really do but, its the mans time to go. At this point we think they only want to operate because they will get paid if they do >.<

Fact is, they won't operate unless someone signs. No one signs, no operation. Problem solved.
