Last saturday night around 8pm a friend and I were out walking on the side of the road when a car went off the road and hit me,the car was going atleast 40 when it hit me and sped up and finally crashed around 10 seconds after it hit me.the rear view mirror hit my back and shattered into peices.the only injuries I have are a few bruises,The left side of my body was hit and it kinda brushed agianst me but still hurt like hell.I dunno what happend to the driver but she ended up at the hospital before me and had to get the jaws of life to get her out,she was alittle over weight.Im really pissed this happend and Im in pain and I dont think i will ever walk on the side of the road for a long time.My dads taking me to a lawyer tomarrow.what should I do,I dont really want to sue this woman unless she was drinking but I dont have money to pay for my medication and hospital visit,that will cost atleast 1,000.Im still in shock and Im still very angry this happend,this is the last thing i needed at this time,I have so much shit to deal with and then an idiot hits me with her car..

If the driver doesn't have valid insurance, then you need to recover the medical costs directly from her.Beyond that, whether you sue her is up to you and your family. Was she or will she be charged with a driving violation, or something worse?

A lot of roads in the U.S. don't have sidewalks. Where I'm from, I'm lucky to see a sidewalk outside city limits.

no there wasent a side walk,i wasnt very close to the road,there was prob like half a foot between me and the road,im not sure,its def not my fault at all though.im going to the doctors office tomarrow,ive been getting very bad headaches every few mins so well see if anything else could be wrong

Sue the biatch, if she has the suitable insurance it'll be a direct claim on her insurance. In the UK it is a legal requirement to have car insurance if u drive and i imagine its the same in the USA, if not sue her ass, take her house, get her paying you back by selling her fat ass on the street. Driving is easy, especially in the US where roads are wide and cars are all automatic, there is no excuse to mow you down. Make sure the bitch cannot even afford to flush the toilet.

That's a bit harsh. Morally, you should only sue for damages and a little more to pay for the emotional hurt. And not all roads are in the US are wide. I travel down many roads every morning where my tires on both sides are on the lines.

Actually, Steve, even if an individual does have medical insurance, the company will go after the driver of the car because their insurance would be responsible to cover the damages.

True, but it's their problem, not the claimants.Although it didn't involve medical claims, when my car was hit while parked on the street, my insurance company quickly reimbursed me for the amount of repairs, minus the deductible. When they finally got the other insurance companies to pay, weeks later, they sent me a check for the deductible.If the person who hits you has no valid insurance (as is very common around here), life gets more complicated. I hope the OP doesn't wind up having to sue the person who hit him.

I read your original post to mean that the driver was only resposible to the extent of medical claims that the injured party paid out of pocket.
Whether or not the driver had insurance is not an issue unless you also do not have insurance. You are correct that if you have insurance, your company will take care of you (less any deductible) and then recover from the guilty party (or the insurance company of the guilty party) whatever they can. You, however, do not get your deductible back until your company has recovered all that they have paid. -

hey... just thought I'd post this pic, this is what happened to me after being hit by a car travelling at about 50mph or 80.47kph.... this was in the UK, and I went through the windshield of the first car, up and over, through the window of the second, and I was conscious for the whole thing.....I was 13 I think... I can't remember, must have affected my memory hee hee... (don't look if your sqemish, it's not that bad... but all the same, just be warned lol) me hit by a car

How are you doing mentally? My friend got hit by a car about 3 years ago and got banged up pretty bad. I think he is a bit traumatized because now he gets really cautionary and paranoid when crossing streets with heavy traffic, or walking on sidewalks near heavy traffic.Worst part is he might start working by times square soon.

Its made me pretty paranoid whenever im near the road,I look both way like 10 times and walk as fast as I can across even when no cars are near. I wait untill theres none on the road and then i'll cross.It made my family mad,My aunt was hit by a car about 5 years ago,she was a crossing guard and was hit,I hear it was a real violent death so they all were bumming when I told them about me.What happend was A friend and I were walking along side the road. There was prob less then a foot of space for us to walk. We were pretty much next to this large ditch/sewer pipe so there was nowhere else for us to walk. It was about 8pm and we were infront of this bar/lounge and its not like it was real dark,they had a few big lights on.Anyways Were walking and I hear the car comming and I feel the wind if the car and I fell pain and hear my friend scream and I fall down to my knees. I had no idea what the fuck happend and I look down and see the car go all the way off the road into a cemetary for a few seconds and then about 50 feet later she swerves into the woods and finally stops. Im still not even sure what happend to her,They took her to the hospital and used the jaws of life to get her out. The fuckin bitch didnt even call to say sorry and neither did any insurance people. Im still not sure If i wanna sure or not,I think if she would have said sorry and shit I wouldnt but she put me in pain,I had sum brusies and one was huge,I was in pain two weeks after and during thanksgiving. I had to go to the docs office because I was having neck and head pains. So I dunno what to do. I just feel like noone cares and of fucking course this would happen to me. its my luck.

I dont really have shit to add here, I think its pretty much all been said, but I do have a question.You were hit by the rear view mirror??you did mean the side view yes?If so was it the drivers side mirror or the passengers side mirror?being smacked by the passengers side is one thing walking near a road, being hit by the drivers means they had to swerve over an entire lane to get ya with that one. Or vice versa in the UK.So long as she had insurance and paid the medical bills and damages I dont think Id be real concerned over it. Watch your ass, there are results that can take weeks to show up and be a permenant disability. The insurance company will settle with yuo as soon as possible to get out of ever having to pay anything big or long term. Make sure you know what your in for because once you sign the claim settlement thats the end of it. Dont sign shit till all aspects have been looked at and the police finish the investigation of why she hit you.Consider talking to a alwyer, Iv had to deal with attorneys whena broad hit me inthe drivers side door of my mustang when she ran a red light. They didnt want to pay shit because she was driving her moms car and had never had a license and was 23. The attorney made shit happen, they paid to replace my car that was totaled, and all medical bills and there were plenty of those.
